Diversity Visa Update: DV-2027 Registration Remains on Hold After Appeals Court Ruling

Updated October 31, 2026 · Welbright Consulting

If you were waiting for the green card lottery to reopen, the latest court decision changes the timeline again. But the phrase “Diversity Visa is blocked again” needs context: the newest ruling concerns registration for DV-2027, rather than a new order canceling every Diversity Visa case.

What changed on October 29?

The Ninth Circuit granted an emergency stay in Red Eagle Law, L.C. v. Rubio, putting on hold the lower court injunction requiring the State Department to reopen DV-2027. The suspended schedule called for a registration announcement by October 29, entry to open by November 1, and selection notifications by December 3. Those dates should no longer be treated as an assured reopening timetable. The appeal continues. Read the October 29 court order.

The panel’s reasoning focused on whether the law firm bringing the case could pursue this statutory challenge. It expressly declined to endorse the Department’s failure to open registration. The stay does not establish that Congress repealed the DV program. Source: Ninth Circuit.

Fragomen’s October 30 update corroborates that DV-2027 remains inactive while litigation continues. October 30 news reporting likewise describes a temporary stay, rather than a final resolution.

Entry, selection and a visa are different steps

Stage What it means
Lottery entry Registering for a particular DV year during its announced entry period. This is the immediate DV-2027 reopening issue.
Selection Being chosen for further processing. Selection is an opportunity to pursue a case, not an approved green card.
Visa issuance A consular decision after application, eligibility review and other required steps. It is separate from entering the lottery.
Adjustment of status A separate USCIS process for eligible applicants already in the United States.

The State Department specifically cautions that selection does not guarantee a visa. Anyone promising a guaranteed result is skipping a critical part of the process. Source: State Department, If Selected.

What do the agencies’ announcements say?

The State Department’s DV-2027 entry notice says registration and selection-result dates will be announced. Its stated October 1, 2026–September 30, 2027 visa-application period is not a lottery registration window. Do not use it as evidence that entries are open.

For DV-2026, a separate case, Medani v. Trump, challenged earlier processing holds. USCIS’s September 4 announcement describes temporary vacatur of its DV adjustment hold and court-directed resumption of adjudication for the covered FY-2026 subclass during the remaining fiscal year. That is different from the DV-2027 registration dispute. USCIS announcement; August 28 court order.

Reading the guidance carefully: The State Department’s August 31 issuance page contains conflicting language: an opening update says the December 2025 pause ended under the court order, while later text still describes paused issuance. That page alone does not establish a new blanket pause. Applicants should check current case-specific instructions and court developments.

DV-2026 also involved exceptional litigation over processing beyond the usual September 30 deadline. A reported October 14–23 consular processing window has already passed as of this update. It should not be presented as a currently open extension or assumed to cover USCIS adjustment cases. October 13 legal update.

What international students should keep in mind

A hopeful immigration headline is not a substitute for managing today’s student responsibilities. F-1 students should continue a full course of study as required, work only with authorization, and speak with their designated school official about status concerns. Source: DHS student guidance.

Keep academic and financial plans realistic while registration is uncertain. Before making immigration filings or travel decisions involving a DV case, seek individual advice from a qualified immigration attorney. Families and working professionals should apply the same practical approach: confirm the DV year, the procedural stage, and the actual scope of any court order before acting.

What to do next

Watch the State Department’s visa announcements for verified entry instructions. Keep your existing case records and notices together, and avoid paying anyone who claims they can guarantee registration access or selection.
