Filing COS application
You will meet remotely with your consultant to file your COS application online. You can use your phone, tablet, or computer for the session, which typically takes 15–30 minutes.

COS pending status
Once filed, your COS application will be in pending status. You’ll receive an I-797C Notice of Receipt as proof. While pending, you may legally remain in the U.S. but cannot study or work. Processing times vary (typically 1–9 months, with an average of 3 months).

If USCIS issues a Request for Evidence (RFE), Welbright can assist you with your response for a discounted fee. Not all cases receive an RFE.

If your COS is approved, you will receive an I-797A Notice of Approval with your new I-94 attached at the bottom. Do not detach the I-94. Submit it to the school to begin your enrollment.

Your consultant will conduct a mock interview with you virtually, upon request. You will also receive a list of documents that you have to bring with you to the interview appointment.

On the interview date, bring the documents with you to the US Consulate. Business casual is recommended . Arrive at the consulate at least one hour before the appointment time.

In general, you will be informed of the result after the interview. If the consul asks for your passport, Congratulations! It will be mailed back with an F-1 visa within one week. You may take as many interview attempts as you like if you did not get a visa.

Filing FORM I-130
You will meet remotely with your consultant to file your preAOS application online. You may use your cellphone, tablet or computer for the meeting. It will take approximately 15-30 minutes.

I-130 pendinG
After successful filing of your preAOS application, you will be I-130 pending. You will receive a letter from USCIS, I-797C, Notice of Receipt as proof of your pending status. You must maintain your current status. to stay in the U.S. legally. You may or may not be authorized to work depending on your current status.

Depending on your case and the adjudicator, you may receive an RFE (Request for Evidence) from USCIS to support your case. Welbright can help you respond to the RFE with a discounted fee.
AOS ELIGIBILITY

I-130 APPROVED
In case that your Form I-130 is approved, you will receive a letter from USCIS, I-797A, Notice of Approval as proof of your eligibility to receive immigration benefits.
While there is no visa limit for Immediate Relative (IR) beneficiaries, the Family-Based (FB) beneficiaries are subject to visa availability, meaning a visa must be available for you based on your priority date (the date the I-130 was filed). Check the monthly Visa Bulletin issued by the U.S. Department of State to confirm that the priority date is current.
If the priority date is not current, you can proceed with filing Form I-485 to request AOS. If not, the beneficiary must wait until their priority date becomes current.
